COMPANY AGREEMENT ON SALARY INCREASES FOR PILOTS FOR 2025

hereinafter referred to as “the Company”,
on the one hand,

Represented by as its union delegate,
hereinafter referred to as “the SNPL”,
Syndicat des Pilotes de Ligne (SPL),

Hereinafter referred to as “the SPL”,
together “the Trade Unions”,
on the other hand,
all together "the Parties".
PREAMBLE
In compliance with Articles L.2242-1 et seq. of the French Labor Code, a negotiation on the themes of the mandatory annual negotiations was launched in 2025.
While the end purpose of this negotiation is to cover all the employees of the Company, whether they be pilots, cabin crew or ground personnel, it has been decided to carry out such negotiation separately in order to cover the distinct particularities of each of these three groups of employees in compliance with the Company's common practices and in order to better take into account their specific working conditions.
In this context, the Company and the Trade Unions met on 22 January 2025 and on 11 February 2025.
Following this last meeting, the Parties agreed to enter into the present company agreement related to the application of the Spanish consumer price of 2024 to pilots’ remuneration.
ARTICLE 1 - DURATION OF THE AGREEMENT
The present agreement is entered into for an indefinite term.
It shall take effect on the date of its signature.
ARTICLE 2 - SCOPE
The present agreement applies to all flight crew employees of the Company assigned to a French base of the Company (hereinafter referred as the "Pilots").
ARTICLE 3 - SALARY INCREASES BASED ON THE SPANISH CPI FOR 2024
The Parties agree to apply a posteriori and retroactively the Spanish consumer price index (hereafter the “CPI”) of 2024 (+2.8%) to all the salary scale of Pilots, under the following terms.
For the past (i.e. up to and including January 2025 payroll), the a posteriori and retroactive application of the Spanish CPI of 2024 to all the salary scale of Pilots shall consist of a retroactive adjustment of the 2024 salary scale from 1 January 2024 to the month of January 2025 inclusive, with February 2025 payroll.
That will correspond to the remuneration that would have been received by the Pilot for the periods of activity under a French employment contract in 2024 and January 2025, with an increase a posteriori of the former 2024 salary scale, which is recalled in Appendix A, by the 2024 Spanish CPI of
2,8 %. The result is the salary scale presented in Appendix B.
This payment will be detailed on the February 2025 pay slip, by salary item and reference period, with retroactive effect from 1 January 2024.
For the future (from February 2025 payroll), the 2024 Spanish CPI of 2024 will be directly taken into account to increase the salary scale of Pilots working under a French employment contract. The new applicable salary scale is included in Appendix B.
For the following years and until the conclusion of a general collective company agreement for Pilots or any other earlier company agreement implementing another principle, the Parties will continue to negotiate annually on salaries, applying the provisions of the Spanish Collective Agreement for Pilots No. 2 in accordance with French law and based on the Spanish CPI for the previous year.
ARTICLE 4 – MANDATORY NEGOTIATIONS PROVIDED FOR BY ARTICLES L. 2242-1 ET SEQ. OF THE LABOUR CODE
It is expressly agreed that this agreement concludes the mandatory negotiations provided for by Articles L. 2242-1 et seq. of the French Labour Code for the year 2025, considering that general negotiations covering all working conditions, including salaries, for Pilots will continue in 2025.
ARTICLE 5 - MEETING CLAUSE AND MONITORING
The Parties agree, should one of the provisions set forth herein become unlawful due to a legislative and/or regulatory and/or case law change, to engage in negotiations as soon as possible in order to handle the situation.
The Parties shall meet at the reasoned request of one of the signatory parties, made in writing and duly motivated, in the event of an urgent difficulty with its application.
ARTICLE 6 - DISPUTE RESOLUTION
Before resorting to the courts, the Parties shall attempt to resolve any disputes arising from the application of the present method agreement between themselves through at least three rounds of negotiations.
ARTICLE 7 - AMENDMENTS
In accordance with Articles L.2222-5 and L.2261-7-1 of the Labor Code, any modification to the present agreement shall require a written amendment, entered into according to the same conditions and formalities as the present agreement.
The Party formulating an amendment request shall inform the other Party by email sent to the union delegates if the request comes from the Company, or to the email address of the Human Resources Business Partner France if the request comes from a trade union, and shall specify the requested amendments to the present agreement.
ARTICLE 8 – TERMINATION
This agreement may be terminated at any time according to the provisions of Articles L. 2261-9 et seq. of the Labour Code, by registered post with acknowledgment of receipt sent to each of the signatories giving three months’ notice.
ARTICLE 9 – LANGUAGE
This present agreement is drafted in French and English. In case of a discrepancy between the two texts, the French version shall prevail.
ARTICLE 10 - FILING AND DISCLOSURE
The text of this agreement, once signed, shall be notified through electronic means to all representative union organizations within the Company.
It will be posted on the Company's intranet.
In accordance with Articles D.2231-2 and D.2231-4 of the Labor Code, the Company shall file this agreement, once in force:
with the clerk’s office of the Employment Tribunal with jurisdiction over the place of signature hereof;
on the online procedure platform of the Ministry of Labor.
This agreement shall also be published in the national database set forth in Article L.2231-5-1 of the Labor Code, in a version in which the first and last names of the negotiators and signatories are not mentioned.

PREAMBULE
Conformément aux articles L. 2242-1 et suivants du Code du travail, une négociation sur les thèmes de la négociation annuelle obligatoire s’est engagée en 2025.
Si cette négociation a pour finalité de couvrir l’ensemble des salariés de la Compagnie, qu’ils soient membres du personnel navigant technique, du personnel navigant commercial ou du personnel au sol, il a été préféré qu’elle soit menée séparément pour couvrir spécifiquement chacun de ces trois groupes de salariés, conformément aux usages de la Compagnie et afin de pouvoir mieux tenir compte de leurs conditions particulières de travail.
Dans ce cadre, la Compagnie et les Organisations syndicales se sont réunies le 22 janvier 2025 et le 11 février 2025.
A l’issue de cette dernière rencontre, les Parties ont entendu conclure le présent accord collectif d’entreprise, relatif à l’application de l’indice des prix à la consommation espagnol de 2024 à la rémunération des pilotes.
ARTICLE 1 - DUREE DE L’ACCORD
Le présent accord est à durée indéterminée.
Il entrera en vigueur à la date de sa signature.
ARTICLE 2 - CHAMP D’APPLICATION
Le présent accord collectif s’applique à l’ensemble des salariés appartenant au personnel navigant technique affecté à une base française de la Compagnie (ci-après les « PNT »).
ARTICLE 3 – REVALORISATION DES SALAIRES SUR LA BASE DE L’IPC ESPAGNOL DE 2024
Les Parties conviennent d’appliquer a posteriori et de manière rétroactive l’indice des prix à la consommation (ci-après « l’IPC ») espagnol de 2024 (+2,8%) à l’ensemble de la grille de salaire des PNT, selon les modalités suivantes.
Pour le passé (soit jusqu’à la paie de janvier 2025 incluse), l’application a posteriori et rétroactive de l’IPC espagnol de 2024 à l’ensemble de la grille de salaire des PNT prendra la forme d’une régularisation rétroactive de la grille de salaire 2024 à compter du 1er janvier 2024 et jusqu’au mois de janvier 2025 inclus, avec la paie du mois de février 2025.
Cela correspondra à la rémunération qui aurait été perçue par le PNT pour les périodes d’activité sous contrat de travail de droit français en 2024 et en janvier 2025, en augmentant a posteriori l’ancienne grille de salaire de 2024, qui est rappelée en Annexe A, par l’IPC espagnol de 2024 de
2,8 %. Le résultat correspond à la grille de salaire figurant en Annexe B.
Ce paiement sera détaillé sur le bulletin de paie de février 2025, par rubrique et période de référence, de manière rétroactive à compter du 1er janvier 2024.
Pour le futur (à compter de la paie de février 2025), l’IPC espagnol de 2024 sera directement pris en compte pour revaloriser la grille de salaire des PNT travaillant sous contrat de travail de droit français. La nouvelle grille de salaire applicable figure en Annexe B.
Pour les années suivantes et jusqu’à la conclusion d’un accord collectif général PNT ou tout autre accord collectif antérieur instaurant un autre principe, les Parties continueront de négocier annuellement sur les salaires, en appliquant les dispositions de la convention collective espagnole des pilotes n°2 conformes à la loi française et en se référant à l’IPC espagnol de l’année précédente.
ARTICLE 4 – NEGOCIATIONS OBLIGATOIRES PREVUES PAR LES ARTICLES L. 2242-1 ET SUIVANTS DU CODE DU TRAVAIL
Il est expressément convenu que le présent accord conclut les négociations obligatoires prévues par les articles L. 2242-1 et suivants du Code du travail pour l’année 2025, considérant que des négociations générales portant sur l’ensemble des conditions de travail, y compris les salaires, des PNT se poursuivront en 2025.
ARTICLE 5 - CLAUSE DE RENDEZ-VOUS ET SUIVI
Les Parties conviennent que, dans l’hypothèse où l’une des dispositions prévues par le présent accord deviendrait illicite en raison d’un changement législatif et/ou réglementaire et/ou jurisprudentiel, des négociations s’engageraient dans les meilleurs délais pour traiter cette situation.
En outre, en cas de difficulté d'application urgente, et à la demande motivée de l'une ou l'autre des Parties signataires, une réunion exceptionnelle pourra être organisée.
ARTICLE 6 - REGLEMENT DES LITIGES
Avant d’avoir recours au juge, les Parties s’efforceront de résoudre entre elles les litiges afférents à l’application du présent accord, lors d’au moins trois réunions de négociation.
ARTICLE 7 - REVISION
Conformément aux articles L. 2222-5 et L. 2261-7-1 du Code du travail, toute modification du présent accord pourra faire l’objet d’un avenant de révision, conclu dans les mêmes conditions et formalités que le présent accord.
La Partie qui formule une demande de révision en informera l'autre Partie par courriel adressé aux délégués syndicaux si la demande vient de la Compagnie, ou à l’adresse électronique du Responsable des Ressources Humaines France si la demande vient d’une organisation syndicale, en précisant les modifications qu'elle souhaite apporter au présent accord.
ARTICLE 8 – DENONCIATION
Le présent accord pourra être dénoncé à tout moment dans les conditions prévues aux articles L. 2261-9 et suivants du Code du travail, par lettre recommandée avec avis de réception adressé à chacun des signataires et sous respect d’un préavis de 3 mois.
ARTICLE 9 - LANGUE
Le présent accord est rédigé en français et en anglais. En cas de conflit entre les deux versions, la version française prévaudra.
ARTICLE 10 - DEPOT ET PUBLICITE
Le texte du présent accord, une fois signé, sera notifié par voie électronique à l’ensemble des organisations syndicales représentatives dans l’entreprise.
Il sera mis en ligne sur l’intranet de la Compagnie.
Conformément aux articles D. 2231-2 et D. 2231-4 du Code du travail, la Compagnie procédera au dépôt du présent accord, une fois entré en vigueur :
au secrétariat-greffe du Conseil de prud’hommes du lieu de conclusion ;
sur la plateforme de téléprocédure du Ministère du travail.
Le présent accord fera également l’objet d’une publication dans la base de données nationale visée à l’article L. 2231-5-1 du Code du travail, dans une version ne comportant pas les noms et prénoms des négociateurs et des signataires.
