La durée des mandats de représentants du personnel au sein de MERCATOR OCEAN est de quatre ans. Au regard des dernières élections professionnelles tenues au sein de l’entreprise, le mandat des membres de la délégation du personnel en exercice arrivera, par principe, à expiration en date du 31/12/2023. Conformément à la réunion d’information et de consultation du Comité Social et Economique en date du 28/09/2023 ; aboutissant au constat partagé qu’un process électoral ayant lieu pendant les congés de Noel nuirait à la préparation de la campagne électorale et à l’implication des collaborateurs dans le processus d’élections professionnelles ; il a été émis le souhait de proroger le mandat des Elus en exercice jusqu’au 31/01/2024, lendemain de la date du second scrutin envisagé tel qu’indiqué dans le planning prévisionnel joint, afin de mobiliser et de sensibiliser le plus grand nombre de personnes dans le cadre des élections professionnelles.
C’est dans ce contexte, que MERCATOR OCEAN et l’ensemble des organisations syndicales représentatives au sein de l’entreprise, se sont rencontrées en vue de conclure un accord de prorogation de la durée des mandats des représentants du personnel.
Il a été convenu et arrêté l’accord suivant en vue du renouvellement des élections des représentants du personnel :
Article 1. Prolongation des mandats des Elus
Les parties signataires du présent accord conviennent à l’unanimité que les mandats (Titulaires et Suppléants) du Comité Social et Economique, qui viennent normalement à échéance le 31/12/2023, sont prorogés jusqu’à la proclamation définitive des résultats des prochaines élections, qui interviendra au plus tôt le 16/01/2024, date du premier tour, et au plus tard le 31/01/2023, en cas d’organisation d’un second tour.
Article 2. Conditions de validité, durée et date d’effet
2.1 Conditions de validité
Le présent accord est conclu à l’unanimité des organisations syndicales représentatives en présences au sein de l’entreprise et est applicable à compter de sa signature.
Le Comité Social et Economique a été informé le 28/09/2023 sur le projet d’accord avant sa signature par les parties.
2.2 Durée de l’accord
L’accord est conclu pour une durée déterminée. Il prendra effet une fois que les formalités de dépôt et de publicité auront été réalisées, et prendra fin le 31/01/2024.
2.3 Dénonciation totale ou partielle du présent accord
Les dispositions du présent accord conclues à durée déterminée pourront, moyennant un préavis d’un mois, être dénoncées partiellement ou totalement dans les conditions prévues aux articles L. 2261-9 à L. 2261-12 du Code du travail. Cette dénonciation devra être notifiée à l'ensemble des autres signataires par lettre recommandée avec accusé de réception. Une déclaration de cette dénonciation devra être déposée auprès de la DRIEETS. Dans ce cas, la direction et les organisations syndicales représentatives se réuniront pendant la durée du préavis pour discuter des possibilités et ou de l’opportunité d'un nouvel accord. En cas de dénonciation, partielle ou totale, tant qu’un nouvel accord ne sera pas intervenu, les dispositions du présent accord continueront de s’appliquer jusqu’à la conclusion du nouvel accord ou à défaut, jusqu’à la fin du préavis susmentionné.
2.4 Révision de l’accord
Le présent accord pourra être révisé, conformément aux dispositions des articles L. 2222-5, L. 2261-7 et L. 2261-8 du Code du travail, dans les conditions suivantes :
Toute demande devra être notifiée par lettre recommandée avec accusé de réception à chacune des Parties signataires et comporter en outre les dispositions dont la révision est demandée et les propositions de remplacement,
Les Parties ouvriront les négociations dans le délai d’un mois suivant réception de la demande de révision,
Les dispositions de l’accord dont la révision est demandée resteront en vigueur jusqu’à la conclusion d’un nouvel accord.
2.5 Suivi de l’accord
En cas de modification du périmètre du Comité Social Economique tel que défini dans le présent accord d’entreprise, une rencontre entre les parties pourra être organisée aux fins de révision ou de dénonciation du présent accord dans les conditions définies ci-avant.
Article 3 : Publicité et dépôt de l’accord
Le présent accord sera déposé par l’entreprise via la plateforme de téléprocédure du ministère du travail (C. trav. art. D2231-4).
Un exemplaire sera adressé au greffe du Conseil des Prud’hommes de Toulouse. Cet accord sera communiqué à l’ensemble du personnel de l’entreprise par mise en ligne sur l’intranet. Une copie sera remise aux représentants du personnel.
L’accord est fait en nombre suffisant pour remise à chacune des parties et pour procéder aux formalités de dépôts. PREAMBLE The term of office of staff representatives within MERCATOR OCEAN is four years. In the light of the last professional elections held within the company, the term of office of the current members of the staff representative’s delegation will, in principle, expire on 31/12/2023.
In accordance with the Social and Economic Committee information and consultation meeting on 28/09/2023, leading to the shared observation that an electoral process taking place during the Christmas holidays would be detrimental to the preparation of the electoral campaign and the involvement of employees in the professional election process; the wish was expressed to extend the term of office of the current elected representatives until 31/01/2024, the day after the date of the second ballot envisaged as indicated in the attached provisional timetable, in order to mobilise and raise the awareness of as many people as possible in the context of the professional elections. It is in this context that MERCATOR OCEAN and all the representative trade union organisations within the company met with a view to concluding an agreement to extend the term of office of the staff representatives.
The following agreement was reached with a view to renewing the elections for employee representatives: Article 1. Extension of the elected representatives' terms of office
The signatory parties to this agreement unanimously agree that the office (Titular and alternate) of the Social and Economic Committee, which normally expire on 31/12/2023, are extended until the definitive proclamation of the results of the next elections, which will take place at the earliest on 16/01/2024, date of the first round, and at the latest on 31/01/2023, in the event that a second round is organised.
Article 2. Conditions of validity, duration and effective date
2.1 Conditions of validity
This agreement is concluded unanimously by the representative trade union organisations present within the company and is applicable as from its signature.
The Social and Economic Committee was informed of the draft agreement on 28/09/2023 before it was signed by the parties.
2.2 Duration of the agreement
The agreement is concluded for a fixed term. It will take effect once the filing and publication formalities have been completed, and will expire on 31/01/2024.
2.3 Total or partial denunciation of this agreement
The provisions of this agreement concluded for a fixed term may, subject to one month's notice, be terminated in whole or in part under the conditions set out in articles L. 2261-9 to L. 2261-12 of the French Labour Code. This denunciation must be notified to all the other signatories by registered letter with acknowledgement of receipt. A declaration of this denunciation must be filed with the DRIEETS. In this case, management and the representative trade unions will meet during the period of notice to discuss the possibilities and/or advisability of a new agreement. In the event of partial or total denunciation, as long as a new agreement has not been reached, the provisions of the present agreement will continue to apply until the conclusion of the new agreement or, failing that, until the end of the aforementioned notice period.
2.4 Revision of the agreement
This agreement may be revised, in accordance with the provisions of articles L. 2222-5, L. 2261-7 and L. 2261-8 of the French Labour Code, under the following conditions:
Any request must be notified by registered letter with acknowledgement of receipt to each of the signatory Parties and must also include the provisions whose revision is requested and the proposed replacements,
The Parties shall open negotiations within one month of receipt of the request for revision,
The provisions of the agreement whose revision is requested will remain in force until a new agreement is concluded.
2.5 Monitoring the agreement
In the event of a change in the scope of the Social Economic Committee as defined in this company agreement, a meeting between the parties may be organised for the purpose of revising or terminating this agreement under the conditions defined above.
Article 3: Filing and publication of the agreement
The present agreement will be filed by the company via the Ministry of Labour's tele-procedure platform (C. trav. art. D2231-4).
A copy will be sent to the clerk's office of the Conseil des Prud'hommes in Toulouse. This agreement will be communicated to all company staff by posting on the intranet. A copy will be given to the staff representatives.
A sufficient number of copies of the agreement will be sent to each of the parties for filing. Fait à Toulouse, le 06/10/2023
