PRÉAMBULE

Les Parties sont convenues d'encadrer et d'améliorer les conditions de travail des salariés appartenant au personnel navigant technique et, à cette fin, se sont rencontrées dans le cadre de réunions de négociation, qui ont abouti à la conclusion du présent accord collectif.

Au préalable, les Parties tiennent à rappeler, à titre purement informatif et de référence, les dispositions légales suivantes relatives aux conditions d’embauche et de travail applicables au personnel navigant technique, outre les dispositions prévues par l’OMA.






  • Représentation du personnel

Le personnel navigant technique est représenté par les représentants du personnel élus et les délégués syndicaux, ou par les représentants du personnel élus seulement, selon les dispositions légales en vigueur.
A ce jour 1 (une) seule section syndicale PNT est active, celle du SNPL France ALPA.

En outre le CSE (Comité Social et Économique) a été élu pour la première fois en fin d’année 2018, et a commencé à siéger.

2 (deux) collèges le constituent :
  • Collège « personnel navigant commercial » ;
  • Collège « personnel navigant technique ».

Les dispositions encadrant le CSE sont celles détaillées dans le Règlement intérieur de ce dernier à l’exception de la suivante :


«La Compagnie s’engage à préserver un équilibre dans la programmation vol des représentants du personnel, sans pénalité : rapport rotations/journées de délégation».


  • Juridiction

Les contrats de travail sont rédigés en français et en anglais et relèvent exclusivement de la compétence des juridictions françaises concernées.

Seule la version du contrat de travail rédigée en français fait foi.

  • Contrat de travail

Conformément à l’article L 6523-1 et 2 du Code des Transports, l’embauche du personnel navigant technique se fait par la signature d’un contrat de travail écrit. Ce contrat inclut :

  • le salaire minimum garanti et le rang du PNT, indépendamment de l’activité mensuelle et annuelle, ainsi que les détails du calcul de la rémunération après le lâcher en ligne ;
  • la date d’effet et éventuellement sa durée ;
  • les conditions d’accomplissement de la mission pour laquelle il a été conclu ;
  • le cas échéant, les conditions d’affectation du PNT sur un poste à l’étranger ;
  • le délai de préavis à observer en cas de résiliation du contrat par l’une ou l’autre des parties ;
  • l’indemnité légale de licenciement ;
  • les conditions de rupture du contrat en cas de maladie, d’invalidité ou d disparition ;
  • le montant de l’indemnité exclusive de départ allouée au PNT dont le contrat prend fin en application des Art. L6521-4 et L.6521-5 du Code des Transports ;
  • le cas échéant les conditions de travail en zone d’hostilité militaire ou civile ;
  • les conditions dans lesquelles seront amortis, le cas échéant, les frais de formation ou de qualification.
  • Base d’affectation

La base d’affectation est le lieu, assigné par l'exploitant au membre d'équipage, où ce dernier commence et termine normalement une période de service ou une série de périodes de service et où, dans des circonstances normales, l'exploitant n'est pas tenu de loger ce membre d'équipage. La base d’affectation est spécifiée dans le contrat de travail.

Le changement de base d’affectation s’effectue par avenant au contrat de travail. Si le changement de base implique un départ à l’étranger, l’avenant contiendra les mentions prévues par l’article L.6523-6 du Code des Transports.

  • Période d’essai
L’embauche d’un personnel navigant technique en contrat à durée indéterminée est sujette à une période d’essai, d’une durée de 4 mois, conforme aux dispositions légales en vigueur pour les cadres (article L.1221-19 du Code du travail).

Dans le cas d’un contrat à durée déterminée, la période d’essai est proportionnée à la durée du contrat lui-même, selon l’article L.1242-10 du Code du travail.

  • Visite médicale professionnelle et visite médicale du travail


Conformément à l’article R4624-28 du Code du travail, les journées de visite médicale professionnelle (Classe 1, initiale ou renouvellement), ainsi que les visites médicales du travail sont planifiées comme Temps de Service (TS). Les frais de transport liés à ces visites sont pris en charge par la Compagnie sur présentation des justificatifs.

Le rendez-vous de visite médicale professionnelle (Classe 1, initiale ou renouvellement) relève de la responsabilité du PNT. Le PNT aura une journée complète programmée par la Compagnie en utilisant le code « OM », de manière flexible sans restriction particulière dans les trois (3) mois avant son expiration.

Le coût de la visite médicale professionnelle (Classe 1, initiale ou renouvellement) sera remboursé par la Compagnie sur présentation du justificatif.



  • Indemnité de licenciement

Conformément aux dispositions du Code de l’Aviation civile, en cas de licenciement du PNT, sauf en raison d’une faute grave, d’une faute lourde, il lui sera alloué une indemnité de licenciement calculée sur la base d’un mois de salaire mensuel minimum garanti par année de service dans la Compagnie, limité à un maximum de 12 mois.

Le montant de l’indemnité exclusive de départ, allouée au PNT dont le contrat de travail prend fin en application de l’article L. 6521-4 du Code des transports, est calculé comme suit :

  • moins de dix ans d'ancienneté : un dixième de mois de salaire par année d'ancienneté ;
  • à partir de dix ans d'ancienneté : un dixième de mois de salaire par année d'ancienneté plus un quinzième de mois de salaire par année d'ancienneté au-delà de dix ans.

Le salaire à prendre en considération pour le calcul de l'indemnité exclusive de départ est égal, selon la formule la plus avantageuse pour l'intéressé, soit au douzième de la rémunération des douze derniers mois précédant la date de départ, soit au tiers de la rémunération des trois derniers mois ; dans ce cas, toute prime ou gratification de caractère annuel ou exceptionnel qui aurait été versée au PNT pendant cette période ne serait prise en compte que dans la limite d'un montant calculé pro rata temporis.
  • Indemnité de départ volontaire à la retraite
Conformément à l’article L. 1237-9 du Code du Travail, un PNT justifiant d'une ancienneté d'au moins 10 ans dans la Compagnie, quittant volontairement la Compagnie pour bénéficier d'une pension de vieillesse pourra percevoir une indemnité de départ à la retraite.

Le montant de cette indemnité varie en fonction de l'ancienneté du PNT dans la Compagnie, à raison de :

  • 10 ans minimum et moins de 15 ans : ½ mois de salaire ;
  • 15 ans minimum et moins de 20 ans : 1 mois de salaire ;
  • 20 ans minimum et moins de 30 ans : 1 mois et demi de salaire ;
  • Au moins 30 ans : 2 mois de salaire.


Le salaire à prendre en considération pour le calcul de l'indemnité exclusive de départ est égal, selon la formule la plus avantageuse pour l'intéressé, soit au douzième de la rémunération des douze derniers mois précédant la date de départ, soit au tiers de la rémunération des trois derniers mois ; dans ce cas, toute prime ou gratification de caractère annuel ou exceptionnel qui aurait été versée au PNT pendant cette période ne serait prise en compte que dans la limite d'un montant calculé pro rata temporis.

ARTICLE 1 - CHAMP D'APPLICATION

Le présent accord s'applique à l'ensemble des salariés appartenant au personnel navigant technique affecté à une base française de la Compagnie (ci-après les « PNT »).

La totalité de ces salariés étant affectée aux long-courriers à la date de signature du présent accord, il est convenu que les dispositions qui suivent ne concernent que les Pilotes accomplissant une activité long-courrier.

ARTICLE 2 - DURÉE DE L'ACCORD

Le présent accord est conclu pour une durée indéterminée.

Il entrera en vigueur le

1er mars 2020.


ARTICLE 3 - CONGES POUR EVENEMENTS FAMILIAUX


Les événements familiaux suivants donnent lieu, sur justificatifs, à l'attribution de congés spéciaux :

  • mariage ou pacs du Pilote : quatre (4) jours ouvrables consécutifs ;
  • mariage d'un ascendant, d'un enfant, d'un frère ou d'une sœur : un (1) jour ouvrable ;
  • naissance d'un enfant ou en cas d'adoption : trois (3) jours ouvrables consécutifs à prendre dans les quinze jours ;
  • décès du conjoint ou de la personne avec laquelle le Pilote est pacsé ou vit maritalement, du père, de la mère, d'un frère, d'une sœur, d'un allié au premier degré ou au deuxième degré (grands-parents et petits enfants) : trois (3) jours ouvrables consécutifs ;
  • décès d'un enfant naturel ou issu d'une recomposition familiale : cinq (5) jours ouvrables consécutifs ;
  • diagnostic d'un handicap chez un enfant, au sens de l'article L. 114 du Code de l'action sociale et des familles : deux (2) jours ouvrables consécutifs.

Les jours d'absence autorisés sont pris le jour de l'évènement, ou si impossible, dans un délai d'un mois après celui-ci.

ARTICLE 4 - CONGES NON REMUNERES


Les Pilotes pourront bénéficier d'un :

  • congé pour création d'entreprise, dans les conditions prévues par les articles L. 3142-105 et D. 3142-65 et suivants du Code du travail ;
  • congé sabbatique, dans les conditions prévues par les articles L. 3142-28 et D. 3142-14 et suivants du Code du travail ;
  • congé de transition professionnelle, dans les conditions prévues par les articles L. 6323-17-1 et R. 6323-10 et suivants du Code du travail ;
  • un congé de proche aidant, dans les conditions prévues par les articles L. 3142-16 et D. 3142-7 et suivants du Code du travail ;

sous réserve d'en informer la Compagnie dans les délais prévus par le Code du travail, avant le début du congé souhaité et que leur absence ne perturbe pas les besoins opérationnels de la Compagnie.

Les Pilotes bénéficient, en outre, du droit à prendre :

  • un congé de présence parentale, dans les conditions prévues par les articles L. 1225-62 et D. 1225-14 et suivants du Code du travail ;
  • un congé de solidarité familiale, dans les conditions prévues par les articles L. 3142-6 et D. 3142-2 et suivants du Code du travail ;
  • un congé pour enfant malade, dans les conditions prévues par l’article L. 1225-61 du Code du travail ;

sur présentation d’un justificatif et sous réserve d'en informer la Compagnie dans les délais prévus par le Code du travail avant le début du congé envisagé, sauf urgence motivée.

ARTICLE 5 - INCAPACITE DE TRAVAIL


En cas d'absence ou prolongation d'absence pour maladie ou accident, le PNT doit immédiatement en informer le Centre de Contrôle des Opérations, par courriel ou téléphone. Cette obligation d'information immédiate s'applique également dès que le PNT anticipe une prolongation d'absence.

En outre, toute absence ou prolongation d'absence doit être justifiée au moyen d'un certificat médical transmis à la Compagnie au plus tard 48 heures après le début de l'absence ou de l'extension d'absence, conformément à l'article L. 1226-1 du Code du travail.


Si la maladie ou l'accident survient pendant le temps d'activité hors de la base d'affectation du PNT, ce dernier devra suivre scrupuleusement les instructions spécifiques prévues par le « Règlement AOC », sauf cas de force majeure empêchant par tous moyens au salarié d’avertir la Compagnie.

A la fin de la période d'absence le PNT doit prévenir la Compagnie de sa reprise de poste en application de la procédure en cas de maladie, afin de permettre l'organisation collective du travail.

  • Il est fait application des dispositions de l'article L. 6526-1 du Code des transports en cas d'incapacité de travail, résultant de blessures ou de maladies non imputables au service, et de celles de l'article L. 6526-2 du même Code en cas d'incapacité résultant d'un accident du travail, d'une maladie imputable au service et reconnue comme telle par un centre d'expertise aéronautique.
  • Les conditions de rupture du contrat de travail en cas de maladie, d'invalidité, totale ou partielle, ou de disparition, sont celles prévues par le Code des transports et le Code du travail.


ARTICLE 6 - CLAUSE DE RENDEZ-VOUS

Les Parties conviennent que, dans l'hypothèse où une des dispositions prévues par le présent accord deviendrait illicite en raison d'un changement législatif et/ou réglementaire et/ou jurisprudentiel, des négociations s'engageraient dans les meilleurs délais pour traiter cette situation.

ARTICLE 7 - SUIVI

Les Parties se réuniront une fois par an :

  • une première fois un an après l'entrée en vigueur du présent accord, pour en vérifier la bonne application ;

  • puis, tous les deux ans, afin d’apprécier l’éventuelle nécessité de réviser le présent accord.

Enfin, en cas de difficulté d'application urgente, et à la demande motivée de l'une ou l'autre des Parties signataires, une réunion exceptionnelle pourra être organisée, sous réserve que la réunion périodique ne soit pas déjà programmée dans les deux mois qui suivent.


ARTICLE 8 - RÈGLEMENT DES LITIGES

Avant d'avoir recours au juge, les Parties s'efforceront de résoudre entre elles les litiges afférents à l'application du présent accord.

ARTICLE 9 – RÉVISION

Conformément aux articles L. 2222-5 et L. 2261-7-1 du Code du travail, toute modification du présent accord pourra faire l'objet d'un avenant de révision, conclu dans les mêmes conditions et formalités que le présent accord.

La Partie qui formule une demande de révision en informera l'autre Partie par courrier recommandé avec accusé de réception, en précisant les modifications qu'elle souhaite apporter à l'Accord.

ARTICLE 10 - DENONCIATION

Le présent accord pourra être dénoncé à tout moment par l’une ou l’autre des Parties sous réserve de respecter un délai de préavis de trois mois et d’en informer l’autre Partie par lettre recommandée avec accusé de réception.

En cas de dénonciation du présent accord par la Compagnie ou par la totalité des organisations syndicales salariées, l’accord continuera de produire effet jusqu’à l’entrée en vigueur de l’accord qui lui est substitué ou, à défaut, pendant une durée d’un an à compter de l’expiration du délai de préavis.

ARTICLE 11 - LANGUE


Le présent accord est rédigé en français et en anglais. En cas de conflit entre les deux versions, la version française prévaudra.

ARTICLE 12 - DÉPÔT ET PUBLICITÉ

Le texte du présent accord, une fois signé, sera notifié par voie électronique à l'ensemble des organisations syndicales représentatives dans l'entreprise.

Il sera affiché sur les panneaux de la Compagnie réservés à la communication avec le personnel.

Conformément aux articles D. 2231-2 et D. 2231-4 du Code du travail, la Compagnie procédera au dépôt du présent accord :

  • au secrétariat-greffe du Conseil de prud'hommes du lieu de conclusion ;


  • sur la plateforme de télé-procédure du Ministère du travail.

Le présent accord fera également l'objet d'une publication dans la base de données nationale visée à l'article L. 2231-5-1 du Code du travail, dans une version ne comportant pas les noms et prénoms des négociateurs et des signataires.

COLLECTIVE AGREEMENT ON PILOTS' WORK CONDITIONS

hereinafter referred to as the “Company”,

on the one hand,

hereinafter referred to as the “SNPL”,

on the other hand,

together the “Parties”.





WHEREAS

The Parties have agreed to regulate and improve the work conditions of employees who are part of the Flight Crew and, to this purpose, met each other in the context of negotiation meetings, which led to the present company agreement.


The Parties would firstly like to recall, for information and reference purposes only, the following legal provisions relating to the employment and working conditions applicable to Flight Crew, in addition to the provisions set out in the OMA.







  • Staff representation

The Flight Crew is represented by elected staff representatives and union delegates or by elected staff representatives alone, in accordance with the legal provisions in force.
To date, there is only 1 (one) active local trade union branch for Pilots, i.e. SNPL France ALPA.

Furthermore, the Social and Economic Council (Comité Social et Économique - CSE) was elected for the first time end of 2018 and is functioning.

It is composed of 2 (two) colleges:
  • One college for “cabin crew”;
  • One college for “flight crew”.

The provisions that regulate the Social and Economic Council are those detailed in its Internal Rules and Regulations, with the exception of the following provision:

“The Company undertakes the responsibility to maintain a balance in the staff representatives’ flight schedules, without penalty: a ratio between rotations/time-off days”.


  • Jurisdiction

The employment contracts are drafted in French and English and are subject to the exclusive jurisdiction of the French courts concerned.

The French version of the employment contract shall prevail.

  • Employment contract

In compliance with Articles L.6523-1 and 2 of the Transport Code, a flight crew’s recruitment is formalized with the signature of a written employment contract. This contract shall provide:

  • The Pilot’s guaranteed minimum wage and rank, independent of the monthly and annual activity, as well as the details of the calculation of the remuneration after the Pilot starts his/her effective flight duty for the Company;
  • the start date thereof and possibly, its term;
  • the conditions of performance of the mission set forth therein;
  • where applicable, the conditions for the Pilot’s mission abroad;
  • the notice period to be complied with in case of the contract’s termination by one or the other party;
  • termination compensation;
  • the conditions of contract termination in case of illness, disability or disappearance;
  • the amount of the exclusive departure indemnity allocated to the Pilot whose contract terminates in application of Articles L.6521-4 and L.6521-5 of the Transport Code;
  • where applicable, the working conditions in hostile military or civilian areas;
  • conditions for the amortization of training and qualification costs.


  • Home base

The home base is the location, assigned by the operator to the crew member, from where the crew member normally starts and ends a duty period or a series of duty periods and where, under normal circumstances, the operator is not responsible for the accommodation of the crew member concerned. The home base is stipulated in the employment contract.

A change of base must be formalized through an appendix to the employment contract. If the change of base involves relocation abroad, the appendix must include the mentions set forth in Article L.6523-6 of the Transport Code.

  • Trial period

The recruitment of a Pilot on permanent contracts is subject to a 4-month trial period, in accordance with the legal provisions in force for executive employees (Article L.1221-19 of the French Labor Code).


In the case of a fixed-term employment contract, the trial period shall be proportionate to the length of the contract itself, in accordance with Article L.1242-10 of the French Labor Code.

  • Professional medical examination and medical examination with occupational health services

In compliance with Article R.4624-28 of the Labor Code, the days of professional medical examination (Class 1, initial or renewal), as well as the medical examinations with the occupational health services are scheduled as a Duty Period (DP).
Transport costs linked to these visits are borne by the Company, upon presentation of receipts.

It is the Pilot’s responsibility to make an appointment for the professional medical examination. The Pilot will have a full day scheduled by the Company under the code “OM”, in a flexible way without any restriction whatsoever in the three (3) months before its expiry.


The cost of the professional medical examination (Class 1, initial or renewal) will be reimbursed by the Company upon presentation of receipts.


  • Severance pay

In compliance with the provisions of the Civil Aviation Code, in case of the Pilot’s dismissal, except for serious or gross misconduct, the Pilot shall receive a termination indemnity calculated on the basis of one month of guaranteed monthly minimum wage par year of service within the Company, up to 12 months maximum.

In application of Article L.6521-4 of the Transport Code, the amount of the exclusive termination indemnity paid to the Pilot, whose Contract terminates, is calculated as follows:

  • under ten years of service: 1/10th month’s salary per year of service;
  • as of ten years of services: 1/10th month’s salary per year of service, plus 1/15th month’s salary per year of service over and above ten years.


The salary that needs to be taken into account for the calculation of the exclusive termination indemnity is equal to either 1/12th of the remuneration paid over the last twelve months preceding the date of departure, or 1/3rd of the remuneration paid over the last three months preceding the date of departure, whichever is most favorable to the Pilot. In such a case, any annual or exceptional premium or gratuity that may have been paid to the Pilot during that period shall only be taken into account within the limit of an amount calculated on a pro-rata temporis basis.




  • Voluntary retirement indemnity

In compliance with Article L.1237-9 of the Labor Code, any Pilot who can prove that he has worked for at least 10 years in the Company and who voluntarily leaves the Company to benefit from an old-age pension is entitled to retirement compensation.



The amount of this allowance changes according to the Pilot’s seniority in the Company., at the rate of:

  • 10 years minimum and less than 15 years: ½ month’s salary;
  • 15 years minimum and less than 20 years: 1 month's salary;
  • 20 years minimum and less than 30 years: 1 month and a half of salary;
  • At least 30 years: 2 months’ salary.

The salary that needs to be taken into account for the calculation of the exclusive termination indemnity is equal to either 1/12th of the remuneration paid over the last twelve months preceding the date of departure, or 1/3rd of the remuneration paid over the last three months preceding the date of departure, whichever is most favorable to the Pilot. In such a case, any annual or exceptional premium or gratuity that may have been paid to the Pilot during that period shall only be taken into account within the limit of an amount calculated on a pro-rata temporis basis.

ARTICLE 1 - SCOPE OF APPLICATION

The present agreement applies to all the employees who are part of cockpit flight crew assigned to a French base of the Company (hereinafter referred as the "Pilots").

Since all of these employees are assigned to long-haul flights on the date of signature of the present agreement, it is agreed that the following provisions apply only to Pilots who perform long-haul activity.


ARTICLE 2 - DURATION OF THE AGREEMENT


The present agreement is permanent.

It shall take effect on

March 1st, 2020.




ARTICLE 3 - LEAVE FOR FAMILY EVENTS


The following family events give the right, upon justification to the allocation of exceptional leave:

  • marriage or civil partnership of the Pilot: four (4) consecutive workable days;
  • marriage of a forebear, of a child, brother or sister: one (1) workable day;
  • birth of a child or in case of adoption; three (3) consecutive workable days to be taken within two weeks;
  • death of a spouse or civil partner or person with whom the Pilot lives in a marital status, of the father, mother, brother, sister, first-degree relation or second-degree relation (grandparents and grandchildren): three (3) consecutive workable days;
  • death of a natural child or child of a blended family: five (5) consecutive workable days;
  • diagnosis of a disability affecting a child in accordance with Article L.114 of the Social Work and Family Code: two (2) consecutive workable days.

Authorized days of absence shall be taken on the day of the event, or if impossible, within one month after the event.

ARTICLE 4 - UNPAID LEAVE


Pilots may benefit from:

  • a leave to create a company, under the conditions provided for by Articles L.3142-105 and D.3142-65 et seq. of the Labor Code;
  • a sabbatical leave, under the conditions provided for by Articles L.3142-28 and D.3142-14 et seq. of the Labor Code;
  • a transition project leave, under the conditions provided for by Articles L.6323-17-1 and R.6323-10 et seq. of the Labor Code;

  • a caregiver's leave, under the conditions provided for by Articles L.3142-16 and D.3142-7 et seq. of the Labor Code;

subject to informing the Company within the time limits provided for in the Labor Code before the start of the desired leave and provided their absence does not disrupt the Company's operational needs.

In addition, Pilots benefit from the right to take:

  • a leave for parental presence, under the conditions provided for by Articles L.1225-62 and D.1225-14 et seq. of the Labor Code;
  • a family solidarity leave, under the conditions provided for by Articles L.3142-6 and D.3142-2 et seq. of the Labor Code;

  • Sick child leave, under the conditions provided for by Article L.1225-61 of the Labor Code;


under presentation of justification document, and subject to inform the Company within the time limits provided for in the Labor Code before the start of the desired leave, except in case of reasoned urgency.

ARTICLE 5 - DISABILITY

In the event of an absence or an extension of absence on account of an illness or accident, the Pilot must immediately inform the Operations Control Centre, by email or phone. This same obligation applies as soon as the Pilot anticipates an extension of absence.


In addition, any absence or extension of absence must be justified to the Company through the communication of a medical certificate no later than 48 hours after the beginning of the absence or extension of absence, in accordance with Article L.1226-1 of the French Labor Code.

Should the illness or accident occur when the Pilot is on duty away from his/her home base, he/she must strictly comply with the specific instructions set forth by the “AOC Policy”, except in cases of force majeure preventing the employee by all means from notifying the Company.

At the end of the period of absence, the Pilot shall confirm to the Company his/her return to work, in compliance with the illness procedure, so as to make it possible to organize the work shifts.

In case of a work incapacity resulting from a non-service-related injury or illness, the provisions of Article L.6526-1 of the Transport Code shall apply, whereas, in case of an incapacity resulting from a work-related accident or illness recognized as such by an expertise center of aeronautical medicine, the provisions of Article L.6526-2 of same shall apply.


The conditions of termination of the Contract in case of illness, disability, whether total or partial, or death are those set forth under the Transport Code and the Labor Code.


ARTICLE 6 - MEETING CLAUSE


The Parties agree, should one of the provisions set forth herein become unlawful due to a legislative and/or regulatory and/or case law change, to engage in negotiations as soon as possible in order to handle the situation.


ARTICLE 7 - MONITORING


The Parties shall meet once a year:

  • a first time one year after the entry into force of the present agreement, to verify that it is properly applied;

  • then, every two years, in order to evaluate the potential need to amending the present agreement.

Finally, in the event of an urgent problem linked to the application hereof, and upon the reasoned request of one or the other of the signatory Parties, it will be possible to organize an extraordinary meeting, provided the periodical meeting is not already scheduled to take place in the next two months.


ARTICLE 8 - DISPUTE RESOLUTION

Before having recourse to the courts, the Parties shall attempt to resolve between themselves any disputes arising out of the application of the present agreement.

ARTICLE 9– AMENDMENTS

In accordance with Articles L.2222-5 and L.2261-7-1 of the Labor Code, any modification to the present agreement shall require a written amendment, concluded according to the same conditions and formalities as the present agreement.

The Party formulating an amendment request shall inform the other Party by registered letter with acknowledgment of receipt and shall specify the requested amendments to the agreement.

ARTICLE 10 - TERMINATION

The present agreement may be terminated at any time by either one of the Parties, subject to complying with a three-month notice period and to informing the other Party by registered letter with acknowledgment of receipt.

In the event of the termination of the present agreement by the Company or by all the employee trade union organizations, the agreement shall remain in effect until the agreement set to substitute it enters into force, or, failing such, for a period of one year with effect from expiry of the notice period.

ARTICLE 11 - LANGUAGE


This present agreement is drafted in French and English. In case of a discrepancy between the two texts, the French version shall prevail.

ARTICLE 12 – FILING AND DISCLOSURE


Once signed, the text of the present agreement shall be notified through electronic means to all the representative trade unions within the Company.

It will be posted on the Company's staff information bulletin boards.

In compliance with Articles D.2231-2 and D.2231-4 of the Labor Code, the Company shall file the present agreement:

  • with the clerk's office of the Employment Tribunal with jurisdiction over the place of signature hereof;

  • on the online procedure platform of the Ministry of Labor.

The present agreement shall also be published in the national database set forth in Article L.2231-5-1 of the Labor Code, in a version in which the first and last names of the negotiators and signatories are not mentioned.
