PREAMBULE
Le présent accord a pour objectif, dans le cadre des dispositions légales relatives à la durée du travail, de mettre en place un cadre juridique adapté et correspondant aux contraintes de l’organisation du travail pour le personnel au sol de la compagnie travaillant en France.
Plus précisément, le personnel au sol de la compagnie easyJet est susceptible d’accomplir, en sus de la durée hebdomadaire/mensuelle de travail à laquelle il est soumis, des heures supplémentaires.
Afin de compenser la réalisation d’éventuelles heures supplémentaires, dont le nombre ne saurait excéder 6,25 heures par mois, la compagnie easyJet entend mettre en place un régime attribuant des jours de réduction du temps de travail (en contrepartie de l’accomplissement d’heures supplémentaires) au bénéfice de son personnel au sol.
Par la signature de cet accord, les parties manifestent ainsi leur volonté d’améliorer les conditions de travail du personnel.
Par ailleurs, le présent accord rappelle certaines dispositions légales relatives au décompte du temps de travail effectif, du temps de pause ainsi que du repos quotidien et hebdomadaire.
Les parties se sont ainsi réunies afin de rechercher l’organisation et le cadre juridique adapté en matière d’aménagement du temps de travail tant aux besoins de la compagnie qu’aux aspirations du personnel au sol.
CHAMP D’APPLICATION
L’accord s’applique au Personnel au sol employé par easyJet sous contrat de travail de droit français, sur une base horaire, cadre et non-cadre, à temps complet.
Sont ainsi exclus les cadres dirigeants au sens de l’article L. 3111-2 du code du travail, c'est-à-dire les cadres auxquels sont confiées des responsabilités dont l’importance implique une grande indépendance dans l’organisation de leur emploi du temps, qui sont habilités à prendre des décisions de façon largement autonome et qui perçoivent une rémunération se situant dans les niveaux les plus élevés des systèmes de rémunération pratiqués dans l’entreprise.
CHAPITRE 1 : PRINCIPES GENERAUX
TEMPS DE TRAVAIL EFFECTIF
Conformément à l’article L.3121-1 du Code du travail, le temps de travail effectif est le temps pendant lequel le salarié est à la disposition de son employeur et doit se conformer à ses directives sans pouvoir vaquer librement à ses occupations personnelles.
Le temps de travail effectif se distingue du temps de présence qui inclut, notamment, les temps de pause.
Seul le temps de travail effectif est retenu pour déterminer le respect des durées maximales de travail et le décompte d’éventuelles heures supplémentaires.
TEMPS DE PAUSE
On entend par temps de pause, un temps de repos compris dans le temps de travail journalier, pendant lequel l’exécution du travail est suspendue et durant lequel le salarié est libre de vaquer à ses occupations personnelles.
Pour les salariés assurant, pendant cette pause, la continuité du service sans pouvoir vaquer librement à des occupations personnelles, le temps de pause sera considéré comme du temps de travail effectif et rémunéré comme tel.
Conformément aux stipulations de la Convention collective nationale du Transport Aérien du personnel au sol, le personnel non-cadre qui ne pourrait, aux heures normales des repas, bénéficier d’un temps d’arrêt supérieur à 30 minutes est considéré comme ayant travaillé sans interruption.
A l’exception des cas susmentionnés, le temps de pause n’étant pas considéré comme du temps de travail effectif, il n’est ainsi pas décompté dans la durée du travail.
DUREES MAXIMALES DE TRAVAIL
Les salariés dont le temps de travail est décompté en heures sont soumis aux dispositions des articles L.3121-18, L.3121-20 et L.3121-22 du code du travail.
En application de ces dispositions, la durée quotidienne de travail effective par le salarié ne peut excéder 10 heures.
La durée de travail effectif ne peut dépasser 48 heures au cours d’un même semaine sauf en cas d’autorisation administrative dans les conditions et modalités fixées aux articles L.3121-21 et R.3121-8 à R.3121-10 du Code du travail.
La durée hebdomadaire de travail effectif calculée sur une période quelconque de 12 semaines consécutives ne peut dépasser 44 heures.
REPOS QUOTIDIEN
La durée minimale de repos quotidien est de 11 heures consécutives.
L’amplitude journalière de travail est le temps écoulé entre la première prise de travail et la fin du dernier service au cours d’une même période de 24 heures. Elle est au maximum de 13 heures.
REPOS HEBDOMADAIRE
Conformément à l’article L.3132-2 du Code du travail, le repos hebdomadaire a une durée minimale de 24 heures auxquelles s’ajoutent les heures consécutives de repos quotidien (11 heures), soit 35 heures au total.
Le jour de repos hebdomadaire est fixé en principe le dimanche, Il est rappelé qu’en application des articles L3132-12 et R3132-5 du Code du travail, il est possible d’attribuer le repos hebdomadaire par roulement.
HEURES SUPPLEMENTAIRES
Article 8.1. – Décompte des heures supplémentaires
Les heures supplémentaires se décomptent par semaine civile ou sur une période supérieure à la semaine et au plus égale à l’année.
Selon l’article L.3121-29 du Code du travail, sauf stipulation contraire d’un accord d’entreprise, la semaine civile débute le lundi à 0 heure et se termine le dimanche à 24 heures.
Il est rappelé que les heures supplémentaires sont exclusivement celles accomplies à la demande de la compagnie.
Par voie de conséquence, les heures supplémentaires réalisées à la seule initiative du salarié, sans avoir obtenu l’accord, y compris implicite, de la compagnie, ne pourront faire l’objet d’une contrepartie sous forme financière ou sous forme de repos.
Article 8.2. – Majoration des heures supplémentaires
Les heures supplémentaires accomplies au-delà de la durée légale hebdomadaire fixée par l’article L.3121-27 ou de la durée considérée comme équivalente, donnent lieu à une majoration fixée à 10%.
La rémunération des heures supplémentaires peut être remplacée, pour tout ou partie, par un repos compensateur d’une durée équivalente à la majoration susmentionnée.
C’est ce dispositif de repos compensateur majoré qui est adopté en contrepartie des heures supplémentaires susceptibles d’être accomplies.
Par commodité, ce repos compensateur majoré est appelé JRTT (Jours de Réduction du Temps de Travail) dans les stipulations du présent accord qui suivent.
CHAPITRE 2 : OCTROI DE JRTT EN COMPENSATION D’HEURES SUPPLEMENTAIRES ACCOMPLIES
PRINCIPE ET SALARIES CONCERNES
Article 9.1 – Principe
La rémunération des heures supplémentaires accomplies, chaque mois, dans la limite mensuelle de 6,25 heures s’effectue par un repos compensateur intitulé « JRTT ».
Ce repos compensateur inclue la majoration stipulée à l’article 6.2 du Chapitre 2 ci-dessus.
Article 9.2 – Salariés concernés
Sont concernés par ce dispositif les salariés occupant les emplois - en CDI ou CDD - visés au chapitre 1 du présent accord.
Sont en revanche exclus de ces dispositions, les salariés saisonniers.
EXPLICATION SUR LES HEURES SUPPLEMENTAIRES COMPENSEES PAR L’OCTROI DE JRTT
Tout salarié visé au chapitre 1 du présent accord travaille sur une base 35 heures par semaine, soit 151,67 heures par mois.
Au titre de l’accomplissement d’heures supplémentaires telles que rappelées au Préambule du présent accord, la durée mensuelle de travail effectif peut être portée à 157,9 heures (i.e., 151,67 heures et 6,25 heures supplémentaires par mois).
JOURS DE REDUCTION DU TEMPS DE TRAVAIL (JRTT)
En contrepartie de l’accomplissement d’heures supplémentaires plafonnées à 6,25 heures par mois, chaque salarié concerné par le présent accord bénéficiera, chaque mois, d’une journée de réduction du temps de travail (dite « JRTT ») - correspondant à 7 heures de repos - permettant de ramener la durée effective mensuelle de travail à 151,67 par mois.
Ainsi, les salariés concernés bénéficieront de 12 JRTT par an, soit un jour de JRTT par mois, pour une année complète de travail et sur la base d’un temps complet.
La notion d’année complète de travail s’entend d’une année de travail débutant le 1er janvier et s’achevant le 31 décembre.
Les jours de RTT seront attribués au 1er janvier de chaque année.
PRISE DES JRTT
Les JRTT mentionnés à l’article 3 du présent chapitre doivent en principe être pris au mois le mois soit 1 jour par mois. Les jours de RTT non pris peuvent être reportés sur un mois ultérieur ou pris par anticipation sur un mois précédent dans la limite de 2 par mois maximum (2 jours maximum peuvent être pris par mois).
Au-delà de cette limite, les JRTT non pris ne peuvent pas faire l’objet d’un report ni être cumulés. Les jours de RTT peuvent être accolés à des congés payés.
Les jours non pris ne peuvent d’un report ou d’un cumul sur l’année suivante et ne peuvent pas non plus faire l’objet d’une indemnisation.
Les JRTT seront pris par journée ou demi-journée sur demande du salarié en accord avec la hiérarchie en fonction des nécessités de fonctionnement de la compagnie et de la base à laquelle est affectée le salarié concerné.
La demande devra respecter un délai de prévenance minimal de 7 jours calendaires. En cas de circonstances exceptionnelles, ce délai pourra être réduit avec l’accord du supérieur hiérarchique à 3 jours calendaires.
Si, en raison des nécessités du service, la ou les dates proposées ne peuvent être acceptées, le salarié en est informé dans un délai de 5 jour calendaire à compter de la demande et, dans ce cas, il est invité à proposer une nouvelle date sur le mois en cours.
Si, pour des raisons liées au fonctionnement de la compagnie, les dates de jours de RTT initialement prévues doivent être modifiées, un délai de prévenance de 5 jours calendaires devra être respecté. En cas de circonstances exceptionnelles, ce délai pourra être réduit à 2 jours calendaires avant la date du changement.
DECOMPTE DES JRTT
La prise des JRTT fera l’objet d’un suivi mensuel.
Un document suivant la prise des JRTT mensuels, sous un format à définir, sera tenu à la disposition de chaque salarié concerné par le présent accord.
INCIDENCES DES ABSENCES ET DES ARRIVES/DEPARTS EN COURS DE PERIODE DE REFERENCE
Toutes les périodes d’absences non assimilées à du temps de travail effectif entraîneront une réduction proportionnelle du JRTT mensuel octroyé.
A l’inverse, les périodes d’absences assimilées à du temps de travail effectif n’impacteront pas l’octroi du JRTT mensuel.
En cas d’embauche ou d’une sortie des effectifs en cours de mois, la durée du travail mensuelle des salariés concernées sera calculée au prorata temporis. par demi-journée
Si le contrat de travail du salarié est rompu en cours de mois sans que celui n’ait pu prendre l’équivalent proratisé du JRTT mensuel auquel il avait droit, celui-ci percevra un compensation financière équivalent au droit proratisé dudit JRTT.
A titre illustratif, si le salarié quitte l’entreprise au milieu du mois et qu’il n’a pu prendre le prorata du JRTT (ex. une demi-journée, soit 3,5 heures), il percevra une compensation financière équivalente à une demi-journée de rémunération calculée conformément à son taux horaire applicable.
DISPOSITIONS FINALES
15.1 Durée de l’accord
L’accord s’applique à compter du 1er janvier 2024, pour une durée indéterminée.
15.2Clause de suivi :
Compte tenu de l’introduction du système de JRTT au sein de la Compagnie, les parties conviennent de se réunir à l’issue d’une année d’application du présent accord afin de faire un bilan sur sa mise en œuvre et évaluer si les modalités d’utilisation des JRTT nécessitent des ajustements.
15.3 Révision
Le présent accord pourra faire l’objet d’une révision conformément aux dispositions des articles L.2261-7-1 et L.2261-8 du Code du travail. Toute demande de révision devra être accompagnée d’une proposition de modification. Par dérogation, un processus de révision pourra toujours être engagé avec les délégués syndicaux en vue de parvenir à la rédaction d’un projet d’avenant au cours des négociations.
La procédure de révision du présent accord ne peut être engagée que par la Direction ou les organisations syndicales qui y sont habilitées en application de l’article L. 2261-7-1 du code du travail.
15.4 Formalités de dépôt et de publicité
Cet accord fera l’objet des formalités de dépôt et de publicité prévues par le Code du travail.
Le présent accord est porté à la connaissance du personnel conformément aux dispositions légales et par toute voie appropriée (affichage, intranet, courrier électronique).
Les parties signataires conviennent que l’ensemble des dispositions du présent accord peuvent faire l’objet d’une publication dans la base de données nationale visée à l’article L. 2231-5-1 du code du travail.
15.5 Protection des données personnelles
easyJet détiendra et utilisera toutes les données personnelles (y compris les catégories spéciales de données personnelles) relatives à ses employés conformément à ses obligations légales, de la manière indiquée dans ‘The Colleague Privacy Notice’ (tel qu'amendé par easyJet de temps à autre). ‘The Colleague Privacy Notice’ est un avis fournissant des informations en vertu des articles 13 et 14 du Règlement Général sur la Protection des Données (UK – GDPR Regulation), ainsi que des lois locales applicables en matière de traitement des données personnelles liées aux contrats de travail et aux relations de travail.
Au cours de leur emploi, les employés auront accès aux données personnelles et aux catégories spéciales de données relatives aux autres employés et clients / clients ou contacts des clients / clients et easyJet leur demande de respecter les politiques et procédures de protection des données d'easyJet à tout moment.
easyJet peut à tout moment mettre à jour ‘The Colleague Privacy Notice’ et ses politiques et procédures de protection des données et aviser par écrit les employés et les organes consultatifs du lieu de travail concernés de tout changement. ‘The Colleague Privacy Notice’ et les politiques et procédures de protection des données d’easyJet ne font pas partie du contrat de travail d’un employé ou de la présente convention collective de travail.
Le présent accord comporte douze (12) pages. Seule la version française fait foi.
1. PREAMBLE
The purpose of this agreement is, within the framework of the legal provisions relating to working hours, to establish a suitable legal framework that corresponds to the constraints of the organization of work for the ground staff working in France.
More specifically, the ground staff are likely to perform, in addition to the weekly/monthly working hours to which they are subject, overtime hours.
In order to compensate for the overtime hours, the number of which should not exceed 6.25 hours per month, the Company intends to implement Reduction of Working Time Days () to the benefit of ground staff to compensate overtime.
By signing this agreement, the parties thus express their desire to improve the working conditions of the staff.
Furthermore, this agreement recalls certain legal provisions relating to the effective working time, rest time, and daily and weekly rest.
The parties have thus met to seek the organization and the suitable legal framework for the arrangement of working time that meets both the needs of the company and the aspirations of the ground staff.
2. SCOPE OF APPLICATION
This agreement applies exclusively to the ground staff of the easyJet company working in France, on an hourly basis, both managers and non-managers, bound by an open-ended contract (CDI) or a fixed-term contract (CDD), full-time.
Executive managers as defined by Article L. 3111-2 of the labor code are thus excluded. That is, managers who are entrusted with responsibilities of such importance that they have great independence in organizing their schedule, who are authorized to make decisions in a largely autonomous way, and who receive remuneration situated at the highest levels of the remuneration systems practiced in the company.
CHAPTER 1 : GENERAL PRINCIPLES
3. APPLICABILITY OF THE AGREEMENT
In accordance with Article L.3121-1 of the Labor Code, working time is the time during which the employee is at the disposal of the employer and must comply with his directives without being able to freely attend to his personal activities.
Working time is distinct from presence time, which notably includes break times.
Only effective working time is taken into account to determine compliance with maximum working durations and the calculation of any overtime hours.
4. REST TIME
Break time is understood as a period of rest included in the daily work presence time in the company, during which work is suspended and the employee is free to attend to his personal activities.
For employees who ensure the continuity of service during this break without being able to freely attend to personal activities, the break time will be considered as effective working time and paid as such.
In accordance with the stipulations of the National Collective Agreement of the Ground Staff in Air Transport, non-managerial staff who could not benefit from a break time longer than 30 minutes at normal meal times are considered to have worked without interruption.
Apart from the aforementioned cases, break time, not being considered as effective working time, is thus not counted in the working duration.
5. MAXIMUM WORKING TIME
Employees whose working time is counted in hours are subject to the provisions of articles L.3121-18, L.3121-20, and L.3121-22 of the labor code.
In application of these provisions, the daily working time performed by the employee cannot exceed 10 hours.
The effective working time cannot exceed 48 hours in a single week, except in the case of administrative authorization under the conditions and procedures set out in articles L.3121-21 and R.3121-8 to R.3121-10 of the Labor Code.
The weekly effective working time calculated over any period of 12 consecutive weeks cannot exceed 44 hours.
6. DAILY REST
The minimum daily rest period is 11 consecutive hours.
The daily working range is the time elapsed between the start of work and the end of the last service during the same 24-hour period. It is a maximum of 13 hours.
7. WEELKY REST
In accordance with article L.3132-2 of the French Labour Code, the weekly rest period must be at least 24 hours plus the consecutive daily rest period (11 hours), i.e. a total of 35 hours.
In principle, the weekly rest day is Sunday, but in accordance with articles L3132-12 and R3132-5 of the French Labour Code, the weekly rest day can be allocated in shifts.
8. OVERTIME HOURS
Article 8.1. - Overtime calculation
Overtime is calculated by calendar week or over a period longer than a week and at most equal to the year.
According to Article L.3121-29 of the Labor Code, unless otherwise stipulated by a company agreement, the calendar week begins on Monday at 0:00 and ends on Sunday at 24:00.
It is recalled that overtime hours are exclusively those performed at the request of the company.
Consequently, overtime hours performed solely at the initiative of the employee, without having obtained the agreement, including implicit, of the company, cannot be compensated financially or in the form of rest.
Article 8.2. - Overtime increase
Overtime hours performed beyond the legal weekly duration set by Article L.3121-27 or the duration considered equivalent, are subject to a 10% increase.
The remuneration of overtime hours can be replaced, in whole or in part, by compensatory rest of a duration equivalent to the aforementioned increase.
This increased compensatory rest scheme is implemented by this agreement, in return for the overtime hours likely to be performed.
For convenience, this increased compensatory rest is called JRTT (Days of Reduction of Working Time) in the stipulations of this agreement that follow.
CHAPTER 2 : GRANTING OF JRTT IN COMPENSATION FOR PERFORMED OVERTIME HOURS
9. PRINCIPLE AND EMPLOYEES CONCERNED
Article 9.1 – Principle
The remuneration for overtime hours performed, each month, up to the monthly limit of 6.25 hours, is compensated by rest time referred to as "JRTT".
This compensatory rest includes the increase stipulated in Article 6.2 of Chapter 2 above.
Article 9.2 – Employees concerned
Employees holding the positions - in permanent or fixed-term contracts - referred to in Chapter 1 of this agreement are covered by this arrangement.
Seasonal employees are, however, excluded from these provisions
10. EXPLANATION OF OVERTIME COMPENSATED BY THE GRANTING OF JRTT
Any employee referred to in Chapter 1 of this agreement works on a 35-hour per week basis, which equates to 151.67 hours per month.
In terms of performing overtime as mentioned in the Preamble of this agreement, the monthly effective working duration can be increased to 157.9 hours (i.e., 151.67 hours and 6.25 overtime hours per month).
11. WORKING TIME REDUCTION DAYS (JRTT)
In return for performing overtime capped at 6.25 hours per month, each employee concerned by this agreement will benefit, each month, from a reduction of working time day (referred to as "JRTT") - corresponding to 7 hours of rest - bringing the monthly effective working duration back to 151.67 hours per month.
Thus, the employees concerned will benefit from 12 JRTT per year, i.e., one JRTT day per month, for a full year of work and based on a full-time basis.
The notion of a full year of work refers to a year of work starting on January 1st and ending on December 31st.
The RTT days will be granted on January 1st.
12. USE OF JRTT
The RTT days mentioned in article 3 of this chapter must be in principle taken on a month-by-month basis, i.e. 1 day per month. Days of RTT not taken can be carried over to a later month or taken in advance of a previous month within the limit of 2/months ( 2 RTT days can be used on a month).
Above this limit, JRTT not used cannot be accumulated or be carried over. However, JRTT can be attached to annual leave.
Days not taken cannot be carried over or cumulated to the next year and neither be financially compensated.
JRTT will be taken by day or half-day at the request of the employee in agreement with his manager according to the operational needs of the company and the base to which the employee is assigned.
The request must respect a minimum notice period of 7 calendar days. In exceptional circumstances, this period can be reduced to 3 calendar days with the agreement of the hierarchical superior.
If, due to service requirements, the proposed dates cannot be accepted, the employee is informed within a period of 5 calendar days from the request, and in this case, they are invited to propose a new date in the current month.
If, for reasons related to the operation of the company, the initially scheduled RTT days need to be modified, a notice period of 5 calendar days must be respected. In exceptional circumstances, this period can be reduced to 2 calendar days before the date of the change.
13. JRTT MONITORING
JRTT will be monitored on a monthly basis.
A document recording the use of the monthly JRTT, in a format to be defined, will be made available to each employee concerned by this agreement.
14 . IMPACT OF ABSENCES AND ARRIVALS/DEPARTURES DURING THE REFERENCE PERIOD
All periods of absence not considered as effective working time will result in a proportional reduction of the monthly JRTT granted.
As opposed, periods of absence considered as effective working time will not impact the granting of the monthly JRTT.
In case of hiring or leaving the company during the month, the monthly working time of the employees concerned will be calculated on a pro-rata basis. Consequently, the granting of the monthly JRTT will be prorated accordingly.
If the employee's contract is terminated during the month without the employee being able to take the prorated equivalent of the monthly JRTT to which they were entitled, they will receive a financial compensation equivalent to the prorated right of said JRTT.
For illustrative purposes, if the employee leaves the company in the middle of the month and has not been able to take the prorated JRTT (e.g., half a day, or 3.5 hours), they will receive financial compensation equivalent to half a day's pay calculated according to their applicable hourly rate.
15. FINAL PROVISION
15.1 Agreement duration
The Agreement applies as from the 1st of January 2024. The measures in this Agreement shall apply for an indefinite period
15.2 Agreement Monitoring clause
In view of the introduction of the JRTT system within the Company, the parties agree to meet after one year of application of the present agreement in order to review its implementation and assess whether the terms and conditions for the use of JRTT require adjustment.
15.3 Agreement amendment
This Agreement may be subject to amendment in accordance with the articles L.2261-7-1 and L.2261-8 of the Labour Code. Any request for revision must be accompanied by a proposal for amendment. The draft amendment will be sent to union representatives. By derogation, a review process can be initiated with the union representatives to draft an amendment during the negotiations.
The Amendment procedure can only be initiated by the management or the Unions authorized to do so in application of article L. 2261-7-1 of the Labuor Code.
15.4 Agreement registration and publicity
This agreement will be subject to the formalities of filing and publication provided for by the French Labor Code.
The present agreement shall be brought to the attention of the personnel in accordance with the legal provisions and by any appropriate means (posting, intranet, e-mail).
The signatory parties agree that all the provisions of this agreement may be published in the national database referred to in article L. 2231-5-1 of the French Labor Code.
15.5 Data Protection
easyJet will hold and use any personal data (including special categories of personal data) relating to its employees in accordance with its legal obligations, in the manner set out in the Colleague Privacy Notice (as amended by easyJet from time to time). The Colleague Privacy Notice is a notice providing information under Articles 13 and 14 of the General Data Protection Regulation together with any applicable local data protection laws regarding the processing of personal data in connection with employment contracts and the employment relationship.
During the course of their employment employees will have access to personal data and special categories of data relating to other employees and clients/customers or contacts of clients/customers and we ask them to comply with easyJet’s data protection policies and procedures in respect of such data at all times.
easyJet may update the Colleague Privacy Notice and its data protection policies and procedures at any time and will notify employees and relevant workplace consultative bodies in writing of any changes. The Colleague Privacy Notice and easyJet’s data protection policies and procedures do not form part of any employee’s contract of employment or of this Collective Labour Agreement.
This Agreement includes twelve (12) pages. Only the French version is bidding.
